You might be right on both counts, I'm definitely not about to expect my off the cuff idea would be a perfect solution.

As for who determines, they should be able to make a case before a judge. Going off the example I gave, in this case someone who is pressing charges could say that he has been threatening them, and while a better option if that can be proven would be to jail them until trial, if that can't happen for whatever reason the judge could issue a concealed carry permit.

That or just issue lawsuits right away anyways, since this violates numerous rulings, and both the US and New Mexico constitutions, isn't being supported/enforced by the sheriffs, isn't being supported by her own attorney general, isn't supported by many notable gun control advocates, and is by her own admission, not going to be followed by criminals.

Oh you're correct they did, but they're still enforcing a state law so they can't be sued, in that case the state would be sued as the officers were acting correctly.

Essentially Qualified Immunity is SUPPOSED to be that if a cop is making the best decisions and following procedure as best as possible, he's protected and the lawsuit needs to be targeted at the department or the state.

In reality it ends up being....cops can't be sued. Because even when they badly break policy individual cops are protected to a ridiculous degree.
