Only if there are distinct similarities in terms of chords/notes/vocal phrasing in a particular song. Just having the 'sound' or the 'vibe' of another artist isn't enough.

This kind of thing has existed throughout the history of music. Classical composers did it openly.

If a song interpolates or samples another song, it's perfectly reasonable that said artist get some kind of writing credit, royalties, etc.

But 50 fucking percent for a similar melody is just ridiculous.

I thought Swift was credited as writer for many of her songs. I mean things like that happen all the time. Pop songs have a lot of different writers. I think like some big old school star has secretly written a shit ton of modern pop songs? But I forget who. Like... Dolly Parton, or someone of that pedigree.

Olivia Rodrigo has a far above average rate of songs being accused of plagiarism. This isn't just "everyone in America is accused of plagiarism".

Since the Blurred Lines verdict (which was a bit bullshit-y), artists have been very wary of being hit with that kind of lawsuit and penalty.

So they err on the side of caution.

It's post-Blurred Lines "stolen". As in it isn't but it sounds similar so it's easier to just give a co-writing credit to avoid the bullshit.

How does pop music exist anymore if this becomes the new standard? It's been a while since I've heard a melody in a popular song that sounded truly original. Most any song is going to have some strong commonality in terms of melody and chord structure as some previous pop song. Pop isn't that different from traditional blues in that after so long, it all kind of sounds derivative (granted, pop can change by its nature in accordance with societal preferences in music, but it tends to be very gradual when assessing it year-by-year and the Western music scale in of itself is already pretty limiting). So are you supposed to seek out songs that sound similar to yours and approach those artists to see how much a cut they want? Do you find the oldest artist with a similar melody and credit them or find the artist with the most similar melody, chords, or now "vibe" I suppose? Can you exploit a loophole by finding a song with a similar melody that is no longer protected by copyright?

To be honest, any standard beyond "so obvious it had to have been stolen" is too much for me. I'm not even familiar with the Olivia Rodrigo or Taylor Swift songs in question, but the lawsuits raised by Marvin Gaye's estate cause me to raise these questions a lot in my mind. So there's my rant.

Honestly even though at first I thought she was generic I'm actually starting to come around on her songs and like some of the ones I been listening to on the radio.

And actually that wasn't even the song I thought sounded similar to Taylor, I like swift but that motion ain't it.

hell no, not if the artist created it themselves and it just happened to sound similar...

thats like saying any movie about rings should automatically give royalties to Tolkien just because they have rings of power in them.

A movie having rings of power is not plaguarism. JRR Tolkien does not have a copyright on Magic Rings.

A generalized sounds like is a far cry from actual theft. The latter has standards that, at least before the Blurred Lines case, were pretty strict.

It's an incredibly common chord progression. Even within the same genre, Boulevard of Broken Dreams did it before Misery Business. Should Paramore be paying them royalties?

If Good 4 U was by a dude, nobody would be saying shit but because both it and Misery Business have female vocals people made a stink about it.

That said, like others have said, similar/repeated melodies is very common. I think the issue here is Rodrigo made claims like "I came up with the melody for Good 4 U completely by myself in the shower one morning."

Atleast be honest about it.

That's because the Blurred Lines verdict which essentially said you can sue people over vibes has everyone overly cautious. It's why basically everyone in the music industry thinks the verdict was terrible.

It's entirely possible that people come up with a simple melody independently. Or are influenced without realising it.

Especially when our common factors here are a very common chord progression and a teenage girl singing about romantic woes.

And even then it's totally fine to be knowingly inspired by a song. Like that's one of the backbones of art. People don't enter chaste mind prisons, cut off from the world to create art. They use their experiences to inform their art, and that absolutely includes other people's art. But what's become increasingly obvious post Blurred Lines is that you should never say your inspirations out loud or they will absolutely be used against you. And that is fucked.
