Check out some old Supreme Court cases, it's par for the course.

Specifically Ozawa v. United States, United States v. Bhagat Singh Thind, and United States v. Cartozian.

First one: Japanese man sues to be considered Caucasian in order to qualify for citizenship. Court says no, everyone knows white people are Caucasian.

So then an Indian man sues for the same, as Indian people have a natural right to being Aryan and Caucasian due to geography and history. Court says no, though he might be Caucasian by default it is "the common understanding" that Caucasians are white.

Then an Armenian man sured and was found to be white.

The courts having their heads up their asses is evidently a feature.

we read the first study (on CE, while back) it was a huge 60+ page pdf, peer reviewed, study out of ... Berkley? USC? Can't remember. I found that msn article looking for it.

there's more articles now, here's another peer review article from the Journal of Sports Medicine:

it's saying that ppl should stop banning trans athletes. They write: "While longitudinal transitioning studies of transgender athletes are urgently needed, these results should caution against precautionary bans and sport eligibility exclusions that are not based on sport-specific (or sport- relevant) research."

i.e. there is none, therefore, stop. It's academic prose to be sure.

just remember: some ppl cite peer-review research and some people are banned from CE

my cardio hasnt been too bad because Im a lifelong runner and walk everywhere, but lol @ the thought of me competing in anything.

Going from being able to lift 50lbs easily to being able to barely lift 50lbs is not fun when your job requires you to lift 50lbs+ consistently

That's the key factor. If you are not a member of the US Swim Team you obviously can't compete at a World Event representing the USA.

You can be mad at the US Swim Team for not allowing Lia to compete on their women's team, but based on the current guidelines outlined by World Aquatics this ruling is correct.

From a technical perspective, which courts super care about, they probably would say that the lawsuit should have been at being wrongfully dismissed from the team rather than being unable to compete.

It sucks but that's how the legal system works. An environmental lawyer friend of mine has a ton of stories of cases ending like that.

It's swimming not football where muscle mass would help. Wrestling is the Olympic sport where one could argue birth sex matters and that was removed.
