At this point, I'm convinced that the only way to save this country is for Biden to use the effectively-unlimited powers granted to him by the SCOTUS to have all Republicans in all levels of government (especially the Supreme Court) immediately, forcibly, and permanently removed from their offices, one way or another, citing how the Republican Party is now openly out to destroy our fragile democratic republic.

And then, once they are dealt with, he must immediately relinquish those powers, ensure that no one can ever have that much power again, and finally, like Cincinnatus of Rome, resign.

It's almost as if having a court of unelected lifetime appointees with no reliable oversight make widespread interpretations of the Constitution and our country's laws was a terrible idea.

For anyone who didn't watch the video, he's saying that this decision has made the president a king in all but name, and only a president's individual restraint is between them and actually using this power.

I've seen him say an opinion was bad, but his summary of this opinion was a bit chilling. He actually seems scared of the potential future consequences.

The thing is it doesn't matter what the SCOTUS wrote about whether or not the SCOTUS gets to decide on whether an official act count is constitutional or not. Biden could theoretically have the current SCOTUS expelled replace them with anyone and have them decide after the fact whether or not it counted as an official act.

I don't know if he can draft laws but he can order acts such as the arrest of 6 members of the SCOTUS and then replace them with interim members who can decide if it was an official act or not.

It's actually wild the only protections the SCOTUS put in for itself is that it gets to decide what is or isn't an official act lol

Immunity doesn't mean he can make people do whatever he wants, it just means he can do whatever he wants with no consequences. The end result is pretty similar, but there's just some extra steps along the way.

and therein lies the danger of project 2025 the key part of it is getting rid of everybody in the federal government from the top on down who might be disloyal or not extreme enough to the republicans and Trump's personal goals, so it's kingly power but a kind is only as powerful as his enforcers

Well no.

Those would be illegal orders, as such military personnel would have no legal defence were they to carry them out.

Such immunity is apparently reserved for the giver of said orders (according to the US Supreme Court at any rate).

The Nuremberg trials kiboshed this by stating that "just following orders" is not a suitable defense for a person. Now, whether the court of this land will abide by the same rhetoric that convicted literal Nazis is another thing. If you can't use the president's private communications to determine his intent, then he is shielded from prosecution. But his underlings shouldn't be. Just following orders is not a suitable defense.

This part right here especially why Legal Eagle is so freaked out by the end, they've effectively created a loop of corruption with this move with the main motivation for carrying it out being like minded people doing it and with no fear of legal repercussions due to pre pardons, can you imagine somebody like Steve Bannon or Charlie Kirk with power like that?

Right, which is why I dont get why so many people say Biden should or needs to forcibly remove, attack, detain, etc. the SC justices and/or other republicans when we all know hes just not gonna do squat except make a few strongly worded speeches and a political ad or two.

Nuremberg trials are irrelevant here from a legal perspective. It was a an international coalition that held them. The closest thing to the modern equivalent is the ICC. Whose authority the US refuses to recognize as it relates to the US.

So it doesn't matter if "only following orders" isn't a valid legal defense. What matters is that Trump won't let someone who follows his orders get prosecuted and no one outside the US will be allowed to do so. Were some state official to try and pursue it at a state level (say whatever state it occurred in) Trump could simply have them killed as well and designate it an official act.

We're talking about after Trump's regime falls, as all fascist regimes always do, and all his former croneys get hauled in in chains. Just as we didn't accept "the fuhrer told me to do it :(" at Nuremberg I, we won't accept "Trump told me to do it :(" at Numberg II.

It's kinda weird how folks think the Republicans will do the impossible and create a fascist state that lasts when the United States is such a terrible place to try it (it's too damn big and there's too many people with disparate outlooks, just for one).

Not everyone. But enough people, in all the right positions of power, will. Others will stand by and do nothing, whether out of fear, complacency, or apathy. And because of the sheer disparity in power between the US's citizens and its government (in particular, the far-too-broad spying powers granted to it in the wake of 9/11, and the high-tech weapons used in war, such as bomber drones, that allow agents of the government to kill without even having to be in the same hemisphere), those who resist will be identified and either killed or locked up soon enough.
