Scenario: McDonalds has cheap food prices in their app. To use their app your forgeit right to sue for any and all reasons. Somehow this is found to be enforceable in court probably by a conservative judge.

Do you accept and use the app?

Yes this means they can poison you and you cannot sue.

Terms of service like that typically aren't even binding. This kind of thing exists to try to bully and pressure people, but if there's negligence or illegal stuff involved, this ToS agreement won't hold up.
