The filing, citing employment data from 2020 and 2024, asserted that Starbucks workforce has become more female and less white over time. Bailey contends that the coffee chain uses quotas to shape its workforce and board of directors, arguing that its policies disadvantage other employees.

According to a 2021 memo from Starbucks, also cited in the lawsuit, the company has set and tracked annual inclusion and diversity goals aiming for at least 30 percent BIPOC representation at corporate levels and 40 percent at retail and manufacturing levels by 2025. BIPOC refers to employees who are Black, Indigenous, or people of color.

Starbucks has also pledged to create mentorship programs for BIPOC employees and provide additional training and advancement opportunities for those groups, according to the memo. Bailey argues that such targeted initiatives violate anti-discrimination laws by giving preferential treatment to certain racial or ethnic groups over others.

With Starbucks discriminatory patterns, practices, and policies, Missouris consumers are required to pay higher prices and wait longer for goods and services that could be provided for less had Starbucks employed the most qualified workers, regardless of their race, color, sex, or national origin, said Bailey via a news release announcing the lawsuit.

Republicans really are making it clear that white men are the only group they're for and even then really only wealthy white men, the uneducated ones can be their loyal foot soldiers oppressing everyone else

In theory, that's how it should be - no special treatment on the grounds of race / etc, it's purely about how qualified, reliable and hardworking someone is. The specific policies being quoted here absolutely are discriminatory. But in practice, you know damn well that what these people really want is no one but white guys having the jobs, and they won't stop at just "can't give others special treatment". It's kind of unfortunate there isn't any serious political force out there that actually wants to just put a stop to discrimination of this kind - only two sides that each want different groups to be the beneficiary of it. (And perhaps, that makes it little surprise that, forced to choose between one or the other, a lot of people would go with the one that at least favors the group they're part of. Because there's no fair option; only "unfair option that helps me" or "unfair option that hurts me".)

Starbucks will hire almost anyone with a pulse and no criminal record (and even then, it depends). Their culture and benefits has created an environment that attracts and retains women, trans people, former service members, and PoC.

Anecdotally: I worked at Starbucks for 10 years. I legitimately had a DM who said "she'd never promote a male (to SM)." It took 7 years for her to get fired, which was only after she went visibly crazy.
Company-wide, I don't think there's any inherent bias towards woman. It's just a job that many women prefer. Once people start making connections (getting friends hired), it cascades. There was a store in my area that was the "bro-store," where males who wanted a more masculine environment would work - but there were 30-40% men in other stores. I moved states and saw similar patterns, no inherent bias towards women, just more applicants (and more PoC because of my area).The only potential bias I did see was their mentorship program which is actively offered towards PoC. They want and encourage PoC to get promoted, but I've never seen a PoC promoted who wasn't overly qualified -- though, anecdotally, I have seen others promoted through pure nepotism and favoritism.
But, I don't see a program that's designed to counteract unconscious bias as a negative, especially in contrast to the alternative.

I think it's less that than an institutional and cultural bias that leads to specific women-dominated fields of employment. Especially in food service.

Like nurses. A lot of people think there's so many women nurses because that's a field women prefer. They never account for the institutional bias of women only being allowed to be nurses until relatively recently. Or the cultural conditioning of women in that role prominently displayed in media. Stuff like that.

I wouldn't default to the idea that it's a job women prefer a much as it is one that they have ready access to, to facilitate paying rent. (Because no one works at Starbucks as a vocation or calling.)

I cannot imagine how anyone actually makes this legal argument in a real court trial. I expect this to not go anywhere.
