By the way, replacing a malfunctioning chip or dead battery counts as a modification. Or selling a game for 10 dollars that teaches you the functions of the Switch 2, when it should have come packaged with the system. Yeah, they protect their employees, as any good company should. But those same values aren't passed to the consumer. They rarely put 1st party titles on sale, and when they do go on sale the sale price is twice what it should be. People want to put them on a pedestal because they are Nintendo, but companies need to be held accountable for their actions. We saw this with Microsoft a few years ago when they tried to ID tag games to a specific console/account, and then Sony a couple years later for reasons I forget about. Both times people called them out on it. I could also mention that I think half the games they produce cost way too much to develop.
