From what I've seen people say, this whole kerfuffle with the EULA is actually nothing. It's just TakeTwo using the same EULA for all of their games. The "root level access to spy on you" is actually for anti-cheat software for their multiplayer games. The data collection is for stuff like their sports games where they want to know who's buying what.
