Gonna be downgraded to a misdemeanor, just like that other person. There is no credibility for this Department of Justice. They are all fucking clowns.

That's twice they failed to indict a ham sandwich. I blame it both on the charges and DoJ not having good lawyers anymore.

Lmao that sandwich artist is going to be back on the streets in no time. Stay vigilant of your surroundings! You might take a sandwich to the face! Our government failed to protect us.

There's no double jeopardy for indictments, even for the same charges.

They'll keep trying.

No Jury would have convicted him. And he would have been dumb to take a plea deal.

I feel like he would only throw a sandwich in someone's face if they deserved it.

What?! What do you mean a subway sandwich isn't a deadly weapon? Haven't these judges ever had the misfortune of eating one?! This is totally a felony!

/s obviously.

I think the problem is more inherent that we're a bit of a lone wolf in using grand juries when most other countries don't have them or abolished them.

But then as we can see, prosecutorial overreach is punished by grand juries at times. Whether it's a coordinated grand jury nullification effort or just not wanting to provide a true bill.

Contrast with Japan where they will hold you until you confess to a crime you didn't commit. Just to chase that 99% conviction rate.

I mean that's a solid take in general but what does that have to do about Jeopardy attaching at Grand jury? That would be kinda ridiculous in its own right.

grand jury is a political tool pretending to be a judicial tool. the jury is hand picked by the prosecution, and the evidence heard is entirely decided by the prosecution. 99 times out of 100 the point of a grand jury is to either hype up a case or give a public reason to quietly bury it.

it does bring up the question. is the prosecutor just a complete dumbass, seems unlikely with the huge amount of education needed to become a lawyer; or did they just not want to pursue the case and just needed some theater.

While that may be true, the fact a hand picked grand jury did not return an indictment that was wanted is very telling.

Not all lawyers are good. I'd imagine there aren't very many good ones willing to do the work of Trumps regime.

the thing is you shouldn't even have to be a good lawyer to win a grand jury conviction, its rigged from the start after all. i can accept that the DOJ lawyers are all raging dumbasses but losing at your own grand jury hearing without intending to is a very low bar.

I suspect they have difficulty finding a jury willing to defend ice especially given that it is basically impossible to get a meaningful injury from a sub sandwich.

Were I put on a jury I don't think I could ever find it in my self to rule in favor of ice

Even though the process is secret, I don't understand how you fuck up video evidence that would normally be sufficient enough for probable cause.

That's either a drooling level of incompetence or DC just not wanting any part of it.

It's probably a little bit of both. This is supposed to be one of the easiest things a prosecutor goes through.
