Burroughs said the Trump administration failed to meet their burden in showing it acted in a non-retaliatory way.
I mean, he literally ran on "I'm going to retaliate against everyone I dislike" and people still put him in office.

I find it very frustrating when people can't even celebrate wins and just reflexively crap on anything good that happens.

My coworkers have spent the last several days working their asses off to get frozen money out the door after a victory by nonprofits against the admin in court. We get emails every week informing us of cases that the admin lost and how we need to implement the decisions.

This idea that nothing matters and he just ignores the courts is false and toxic. It may make people neglect to protect their rights because they think they're already lost.

He's definitely a criminal that tries to flout the law whenever he thinks he can get away with it, but a win is a win is a win.

people do this because they understand reality, that anything decided by a lower court will just get reversed by the supreme court. all this ends up being is a speed bump, in the meantime the grand recipients will fail because the money will still be contested and in the end the supreme court will just go back to sucking off trump with their pro-dictatorship decisions.

the system is broken and more and more people are accepting that fact. maybe it'll lead to action.

That's not true. The vast majority of these cases don't go to the Supreme Court. You just never hear about those, you only hear about the ones that do.

I really doubt that random laymen on Gamefaqs understand these dynamics better than federal government attorneys that have to implement this stuff.

Maybe I need to just stop talking about this stuff, it's exhausting.

Even if lower court victories dont stop anything if they can slow shit down even a little thats a win. One of the most important weapons our side can wield against Trump is time. We need to wield time the same way he did to bypass all his legal troubles.

He doesn't always ignore them either.

That said, we really need to find a way for the US Marshalls to at least be under judicial control or at least not be under DoJ. It would go a long way towards being able to drag people in for contempt hearings.

This, ffs. I'd love to to see the Venn diagram between the "why isn't anyone fighting back?" crowd and the "whatever, Trump'll just ignore it, none of this matters" crowd.

Pessimism almost always tries to sell itself as realism. Because as we all know, nothing makes for a better motivator than crippling despair and hopelessness.

It would nearly be a perfect circle.

edit: actually replace the why isnt anyone fighting back crowd with the they backed down in court, cowards crowd. Id love to see the overlap between people who get mad over court losses while simultaneously refusing to celebrate court wins.

You speak the gospel truth. It's a sign that he has people feeling so defeated that they're jumping at shadows that aren't even there and laying on the ground in prep for blows that might never come.

whats more real then the fact that we took a child hungry pedophile, an admitted rapist, a man who committed treason when he tried to overthrow the election, and showed him that there are no consequences for his actions and yeah he can become president again?

what i find weird is the people screaming about pessimists all the time. that insult gets thrown around a lot by people that just keep ignoring reality. after all it was pessimistic to believe trump could actually beat hillary. it was pessimistic to believe that he wouldn't be held accountable for his criminal actions. it was pessimistic to believe he'd win again.

honestly i think its insane for people to keep looking at these situations, seeing the outcome that shows again and again that trump will never be held accountable by the current system, and continue to argue that "this time" it'll happen.

I don't have the time nor the inclination to personally apologize for all the eternal optimists out there who didn't recognize the very real threat of a 2nd Trump term and his skirting of the law at every turn, so I'll simply suggest that a realist accepts a bad situation, attempts to do what they can to manage it, and doesn't turn their nose at successes, however small, towards styming this regime's march to the bottom. Whereas a pessimist would suggest something like "if everyone accepts how hopeless the situation is than maybe that will somehow motivate everyone to collective action."

Imagine being called a pessimist for not thinking Donald Fucking Trump will follow the law.

It's like being called a pessimist for leaving your house when a CAT-5 hurricane is about to hit your area.

Pessimism is saying big deal this victory means nothing why even have it oh by the way Id totally be mad if the judge ruled in Trumps favor.

Optimism is realizing well at least Trump will have to devote time and resources appealing, time and resources taken away from some other horrible thing.

Turn Trumps own tactics against him. Litigate everything. Flood the zone! Keep his focus on court battle after court battle. Time is our weapon. Time is our bludgeon. Time is his weakness. Tick tock Mr. President.

Trump will probably ignore it.

But - I agree that we should enjoy these victories when they come up. The courts saying stuff is illegal is a step in the right direction and much better than the courts saying nothing is wrong.

Are these people saying "everything's fine, quit worrying!" in the room with us right now?

And boy howdy did you pick a prize-winning analogy, considering that I've personally had to deal with / evacuate from several major hurricanes in my lifetime, have on several occasions had to work my ass off trying (and not always succeeding) to talk stubborn family members into evacuating, and have stared down the barrel of 'what's the fucking point' hopelessness after our house got flooded twice in the span of two weeks last year. Under that analogy, the advice from the "realists" in this topic who balk at being labeled pessimists would go as follows:

"Should we put up the storm shutters?"
"Meh, don't bother, the hurricane'll probably blow them off."
"Should we get some sandbags?"
"Whatever, the storm surge'll probably get higher than that."
"Should we put our belongings up on shelves in case floodwater gets in the house?"
"That's a waste of time, the hurricane'll just knock the whole house down."
"Should we load up what we can in the cars and drive to the other side of the state?"
"I wouldn't, you'll probably have a breakdown or get stuck in traffic."
*hurricane hits*
"Should we try to clean up the house as best we can and get the ball rolling on replacing the drywall?"
"Nah, fuck it, hopefully insurance will fix it or everything will eventually get better somehow."
