That's like saying is hypocritical to shoot someone for shooting at you first.

Whether death or life in prison is worse is heavily opinion based.
Also, keeping someone in prison for the rest of their life is expensive for the tax payer. The point of the death penalty isn't to make the criminal suffer, it's to just get rid of that person. If you wanted to make the person suffer, you'd torture them.
