Does this actually mean anything though? The judge ruled that the valuation of the payout needs an explanation that is not provided.
The same issues remain as did in January. The judge has not stated that a shareholder vote will act as a curative.
This is just going back in front of the judge. The judge that stated Musk is trying to exercise undue influence is going to hear an argument that Musk threatened to damage Tesla if he was not given this package and consider that coercive. The judge that stated the value needs to be explained and hear an argument saying the same methodology that was not explained was used. The same judge that said Denholm was not suitably independent is going to hear arguments that Denholm has not become independent.
That's beyond application of logic to some of the conditions in the deal which no doubt any complainants will make.
I wonder how long this will take to settle.
