Yep. It's what's called being "defamation proof." It's basically part of the "damages" portion of the analysis because the statement needs to be the cause of damage

You have to prove damage actually occurred. It doesn't matter if they're proven to be horrible people already. If somehow you make them suffer even just a little bit more then it counts.
