Now cops can arrest and jail or deport migrants.

The Supreme Court on Tuesday cleared the way for Texas to immediately begin enforcing a controversial immigration law that allows state officials to arrest and detain people they suspect of entering the country illegally.

The courts three liberals dissented.

Legal challenges to the law are ongoing at a federal appeals court, but the decision hands a significant yet temporary win to Texas, which has been in an ongoing battle with the Biden administration over immigration policy.

The court had been blocking the law from taking effect, issuing an indefinite stay on Monday, which was wiped away by Tuesdays order.

Senate Bill 4, signed into law by Texas Republican Gov. Greg Abbott in December, immediately raised concerns among immigration advocates of increased racial profiling as well as detentions and attempted deportations by state authorities in Texas, where Latinos represent 40% of the population.

As is often the case in emergency applications, the court did not explain its reasoning.

However, a concurring opinion written by Justice Amy Coney Barrett, joined by Justice Brett Kavanaugh, explained that the appeals court had only handed down a temporary administrative order.

So far as I know, this court has never reviewed the deci sion of a court of appeals to enter or not enter an administrative stay, Barrett wrote. I would not get into the business. When en tered, an administrative stay is supposed to be a short-lived prelude to the main event: a ruling on the motion for a stay pending appeal.

Barrett said she thought it was unwise to invite emergency liti gation in this court about whether a court of appeals abused its discretion at this preliminary step.

Liberal Justice Sonia Sotomayor said the order invites further chaos and crisis in immigration enforcement.

The law, Sotomayor wrote in her dissent, upends the federal-state balance of power that has existed for over a century, in which the National Government has had exclusive authority over entry and removal of noncitizens.

Texas can now immediately enforce its own law imposing criminal liability on thousands of noncitizens and requiring their removal to Mexico, Sotomayor wrote. This law will disrupt sensitive foreign relations, frustrate the protection of indi viduals fleeing persecution, hamper active federal enforce ment efforts, undermine federal agencies ability to detect and monitor imminent security threats, and deter nonciti zens from reporting abuse or trafficking.

And I'm sure we can be assured there will be absolutely no racial profiling going on by police in Texas in regards to this. Zero. It will all be above board.

Georgia is adding their immigration law this month too.

https://www.npr.org/2024/03/19/1239323195/immigration-crackdown-georgia-legislature-laken-riley-border

Georgia Republican lawmakers are advancing a bill that would require local and state police to identify, arrest and detain undocumented immigrants responsibilities normally reserved for federal immigration enforcement.
The proposal gained momentum after a Venezuelan migrant was arrested in the killing of Laken Riley, a 22-year-old nursing student in Athens, Georgia. Immigrant rights advocates in the state say the bill demonizes immigrants, pointing to research that shows undocumented immigrants commit crimes at lower rates than others.
But Republican state Rep. Jesse Petrea, the bill's sponsor, said it will bolster public safety.
"We have the greatest border crisis in our nation's history," he said. "In Georgia, the people of this state, the people we represent, are expecting us to do something. And I think this is a good way to do just that."
The proposal is similar to Senate Bill 4, the Texas measure that empowers state and local police to arrest people who illegally cross the southern border and allows local judges to deport migrants out of the country. The U.S. Supreme Court recently rejected an emergency request by the Biden administration to block the Texas law.
Georgia's bill would require law enforcement to check immigration status during encounters and work with Immigration and Customs Enforcement to hold those arrested. It would also require jails to check with immigration officials to determine if people in their custody are in the country illegally.
Opponents argue the bill will lead to racial profiling.
"This bill will force human beings to live in fear and burden local governments and law enforcement officers by expanding their responsibilities, without a penny of state funding," said Democratic state Rep. Pedro Marin, the legislature's longest-serving Latino elected official.
Georgia sheriffs say they already comply with federal requests for citizenship information, and have expressed worries that the proposal would overburden their departments.
"It's not about making Georgians safer," said Jerry Gonzalez, the CEO of the Georgia Association of Latino Elected Officials. "The issue is about using an opportunistic situation, to target wholesale, an immigrant and Latino community and that's really divisive and it's dangerous politics they're playing."
Immigrant rights advocates in Georgia say the bill is motivated by the upcoming presidential election, and multiple advocacy groups have held events condemning the legislation.
Ben Williams, president of the Cobb County chapter of the Southern Christian Leadership Conference, compared the bill to Jim Crow policies.
"Bashing immigrants now, bashing descendants of slaves at an earlier time, is a tried and unfortunately true approach to keeping people divided," he said.
But Republicans in Georgia insist they're addressing immigration in a meaningful way.
"Fixing policy in the face of unspeakable tragedy is not politics," said Republican state Rep. Houston Gaines, whose district includes Athens, where Laken Riley was killed. "It's doing the right thing to ensure something like this never occurs again."
The bill has passed out of the Georgia House of Representatives but still needs to clear the state Senate before it can head to Republican Gov. Brian Kemp's desk.

Biden administration needs to start ignoring Supreme Court rulings. Aside from the obvious corruption, they have no power to enforce their rulings.
No more shall man have wings to bear him to paradise. Henceforth, he shall walk.
This will absolutely end up with legal residents and citizens being deported. It will also end up with people dead because it's fucking Texas and their cops are the same trigger happy maniacs that all our cops are, only more so.

At some point we, as a nation, are going to have to deal with this court the GOP has saddled us with. It's rulings are almost all in bad faith and exist to further the power of a party filled with Nazis. That's bad, and needs to be dealt with.
Furthermore, The GOP is a Fascist Organization and must be destroyed
NYPD's stop and frisk was a "colorblind" law and was overwhelmingly used on black and Hispanic populations.

This law is going to have bodies in the first 48 hours and that's the basic racist idea.

Whole nation, but yeah.

Honestly, kind of the saving grace here, as fucked as it is. If state sees a (massive) downturn in agricultural activity, it'll be a forgotten rule that will be abused by some upstart racist fuck until he gets told to stop.

This whole thing is literally just performative to make it look like they're doing something about the border crisis when in reality they'll make a small show of enforcement but reel it back before actual damage is done to the economy. The GOP backers will demand it so.

They never do. Unless those Republican led businesses are facing a unionization push. Then suddenly ICE shows up and deports a bunch of people but somehow, miraculously, the owners never get in trouble for most of their workforce being illegal.

Texas Republicans would be more than willing to pass news laws that would tax TX residents to fund their immigration shit.

I wonder how Republican Latinos in Texas will react once they start getting targeted. There are quite a large number too, iirc about 50% of Latinos in Texas are and vote Republican.
Now, can someone kindly explain to me why Latinos would ever want to vote Red?
