They asked me if marijuana was illegal. I told them yes, Erica De La Rosa said.

LMAO.

Obviously a good thing to get the stuff away from the kids but them asking if it's illegal and her not knowing the facts is hilarious. It also implies that the kids might have some idea that it's been legalized but they're not really sure because they're kids.

It's kind of a weird story though because what four kids just go to a random stranger and say "hey we found some weed" instead of going to their parents or teachers?

In her defense, carrying that much weed IS illegal in CA.

Especially when the accompanying materials that were with it made it obvious the intentions were distribution.

Where does it say how much it was? Doesn't say anything about it being over an ounce.

I figured that was assumed when you read what else was in the box.

So it doesn't, gotcha.

It definitely could be more but you stated it so confidently I assumed I missed it somewhere in the article.

Oh hey you found proof, nice.

Yeah. So she was actually correct in saying that much weed IS illegal to possess.

Yeah but she didn't say "that much weed is illegal to possess", she just said it's illegal in general. Which is untrue for Cali.
LOL, has she been trapped in a closet since 2016? It's been recreational for almost a decade now.

a scale and a bunch of bags is pretty much always going to get you hit with intent to distribute even if the amount is technically legal otherwise though

Im not going to argue semantics (too late?) but she was talking to elementary school kids. I dont know if it was necessary for her to get into technicalities of Well, once youre 18, and its an ounce or less, and you dont intend on distributing it, yes it is. Otherwise it is not.

It was 4 random kids asking her, not a court of law.

Maybe its just the parent in me, but if 4 elementary aged kids that I dont know come up to me and ask if weed is illegal, Im probably telling them Yes as well. Because at their age, it is.

Theres also the chance that she didnt know the laws herself.

I havent smoked in years, definitely not since its become legal in NY. I have no idea what the laws are as far as how much I could possess. Just looked it up. Apparently its 3 ounces.

But I do know you have to be over 21, so if a couple of 10 year olds start asking me about weed, Im telling them its illegal for them to have it.

if a group of kids found a 6-pack of beer and asked you if it was illegal, would you say "Yes" for thes same reason? or would you tell them "this is for adults"?

Well, like I said above, Im a little more well versed in the alcohol laws than the marijuana ones, so I probably wouldve said no its not illegal, but you guys are too young to have it. Where did you get this?

I feel like this woman handled the situation appropriately and its kinda mind boggling to me how many of you think she was somehow in the wrong here because she didnt (because of lack of knowledge, ignorance, or some other reason) give these kids a proper legal lesson on marijuana possession

i don't think she was wrong at all for taking it away from the children. i just think it's mildly amusing how stuffy she was over weed, especially given that she lives in CA.

"theres a trunk full of drugs in the parking lot and nobody is doing anything about it!?!!?!?!?!?!". like, chill out lady. its just weed and if you don't want it, just toss it in a dumpster or something. but she's over here acting like she found a pound of fent with how she expects the police to react.

Maybe that was all a front, and she owns a dispensary and didnt want that street weed cutting into her business. Lol.

Wow someone thought Marijuana was illegal, wow what a crazy thing to think in a country that is still jailing people for Marijuana possession. What an IDIOT.

Lets not get pedantic about the topic either, because heroin isn't illegal. Possession, manufacturing, and distribution are.

My friend got gifted an ounce for giving a co-worker a ride home.

He then gifted it to me for no reason at all.

Funny all these years people were going to jail, and such, over a plant.

But if you look at California laws, its more illegal than legal

Have to be 21 (or 18 if its medicinal)
Cant smoke where its also illegal to smoke cigarettes.
Cant smoke within 1,000 feet of a school, day care center or youth center while kids are present.
Cant posses more than 1oz.
Must have it in a sealed container when transporting, or must be in the trunk.

i have zero objections to taking the weed away from the children, she was right in doing so. but her expectations regarding the reaction by LEOs are unrealistic, as seen by their response.
