Take out Uncharted and throw in MW3 and you've probably got the final list.

Probably take out Portal 2 as well. Spike fans love their 360 games and their shooters. Portal 2 and Uncharted 3 fail one or both of these requirements.

Batman is awesome enough to overcome its lack of gunplay, however.
