I mean, strictly speaking, you could always use copyrighted work without permission, as long as the copyright owner never noticed or didn't care. It's still illegal mind you, but to some people that doesn't matter.

That said, if this guy copyrighted his avatar, or the artist owns the copyright, there is a strong legal case for IP theft. And to anyone who says "they won't be able to find the guy who stole it!" I want to point out two things:

1. The FBI cracked Tor and shut down Silk Road and have been wack-a-moling its successors since. Anything online is traceable with enough effort.
2. The people who own the selling platform have a vested interest in throwing whoever made the NFT under the bus. And they probably have better lawyers than some dipass who thought he'd make an NFT of some YouTuber

And actually, is the YouTube logo on that NFT? Alphabet (Google), probably won't take kindly to their trademark being used for someone's profit without their permission either. And Google has a lot of money, and a legal department with a larger budget than the navy of the Democratic Republic of the Congo.

Yeah, I agree. You don't have Gen Xers obsessing over Transformers, or whatever the hell the popular thing for them growing up was, not on the scale I see Millennials obsess over Harry Potter. But then you have Millennials into their 40s just obsessing over what's really young adult, at best, literature. I don't get it. Is it because of social media making it easier for people to connect and normalize their obsession rather than hide it? Anyway, for the Harry Potter Universe to work, you have to remember that wizards are incredibly over-reliant on magic to solve their problems. To the extent the first book used a logic puzzle as a road block. It's shit like "Why invent a better form of communication when I can shove my head into a fireplace?" You look at how the world of wizards and witches is presented in England, I half expect American magic users to be mistaken for Amish.

Log Horizon sort of does that. It's got the whole SAO sucked into a video game thing except they're in the actual game world and early plot points are stuff like "the food we spawn with the cooking menu tastes like sand."
