There's no way Nintendo would drop this trailer in a lot somewhere for the driver to pick up. It wouldn't have left their warehouse without the driver signing the BOL and a warehouse employee checking and sealing the trailer.

The thieves could have been following the truck since it came out of Nintendo of America.

A chase car opening trailers when they stopped until they found the goods, and a tractor trailer of their own to park right next to it, load up and go.

This is really sus for the truck driver. It would be nearly impossible not to feel movement and hear something while someone is inside your trailer unloading tons of freight, while you're in the cab. And for that much freight to be taken out of the trailer while parked at a truck stop, it's hard to believe no other drivers noticed the looting of this trailer. And the driver doesn't know what city it happened in? That's at the least an admission that he wasn't doing proper pretrip and post trip inspections and didn't notice that his truck could suddenly accelerate much faster (since his trailer got lighter).

I paid using PayPal, which might complicate the charge back route. Their purchase protection program states:

Your claim will not qualify for a refund under PayPals Purchase Protection program for an Item Not Received claim, if:
  • You collect the item in person, or arrange for it to be collected on your behalf, including if you use PayPal in a sellers physical store, except for in-person PayPal QR code goods and services transactions, or
  • The seller has provided proof of shipment or proof of delivery.
If the seller presents evidence that they delivered the goods to you, PayPal may find in favor of the seller for an Item Not Received claim even if you claim you did not receive the goods.

I don't know if they stamps on my boxes are enough evidence to counter the tracking information showing the packages were delivered.

There must be legal protection for these situations. Look into that and send RYSE an email, giving them a chance to fix this before you take legal action. They must send the goods or refund the payment.

Most times, this will get you the response you want. That email you got about them already sending one replacement is just bullshit and has nothing to do with your consumer rights. They are trying to fob you off so you deal with someone else or drop it. Companies do this all the time because they know a lot of people will just fold at that stage. Show them you won't, and it's usually a different story.

"Legal protection" would be suing them in small claims court. I'd like to give them another chance before going to all that effort. But I don't want to threaten to sue in the email, since most people who do that never follow through. They'll just get the summons if I don't get my order or my money back.

RYSE supplements had 40% off all orders on their website for Black Friday. Their whey protein powders and greens have been my favorites for a few months, so I cashed in on this discount and ordered $419 worth of stuff. It would have cost $700 full price. Great deal, right? I was excited to try some new flavors.

17 days later, two boxes show up on my doorstep, and they are way too light to contain all the stuff I bought. One of the boxes was stamped "damaged in handling" by the USPS. I got my camera and recorded the unboxing for proof that I didn't receive all of my order. Only 2 of the 18 things I ordered were in the boxes! Along with several things I didn't order that weren't even from RYSE. I sent them an email with my video, and they were very understanding.

Response from RYSE:

"Hello, very sorry to see the complications with your order. I will reship you the missing products for this order!"

Wonderful! I tracked the replacement shipment from Texas to my city, where a week later an EMPTY BOX arrives. The tape holding the box flaps closed had broken and become unstuck in transit. This box was stamped, "received without contents" by the USPS. I spoke to the postal carrier when she delivered it and she gave me a number to call, but nobody ever answers. So I send RYSE another email explaining what happened, attaching photos of the stamped box, and advising them to file a claim with the USPS, and that they will likely need to ship it a third time. Please use more tape, I requested.

Their response took almost a week. This is their last email:

"Hello, unfortunately since we have already shipped out a replacement for this large order we will be unable to fulfill another replacement. For further steps you will need to file a claim with USPS to have this issue resolved.

What a frustrating response. Besides just being piss-poor customer service, a USPS claim for over $100 requires proof of insurance fees paid. That's why I asked the shipper to file the claim. I don't have that receipt, if it was even adequately insured. And I would really like the stuff I paid for, not to be told to take it up with the postal service.

I'm thinking about how to handle this, and how to best word the email for maximum results. Any advice or similar experiences?

It absolutely is. I don't dispute that Britney's cultural impact was enormous. Queen of the years she was popular, sure. But would you also award her for the 8 years prior to her debut, during which several other female solo artists sold more albums than Britney did in the 90s? Even if you count 2000-01 as the 90s era. It's certainly a biased claim toward the years more recent in memory.

She didn't release a song until Q4 1998. How does a pop music DJ forget about Maria Carey? All genres considered, Celine Dion and Shania Twain have more claim to that title than Britney Spears. It's a pretty absurd thing to say.
