Then you'd have people complaining that they're being forced to download patches they don't want/need.
Or, like in the case with the occasional Sony patch, a save corrupting update can't be warned about and avoided.
They do need the patch. They need it to play with people who have the DLC. It's a much better (for the customer) solution than what's currently done.
