Actually, choosing not to enforce a law happens pretty regularly, both in positive and negative ways.
Positive: the Egyptian military refused orders to shoot civilians during the Egypt protests.
Negative: sodomy laws in the USA, which prohibit any kind of sex that doesn't result in babies (so blowjobs, anal, etc) were almost never used against heterosexual couples, and almost exclusively used to arrest people for being gay.
Negative: I'm pretty sure I've gotten out of a traffic ticket in Georgia purely due to being female and acting kind-of clueless.
