If the use of the tool is unsanctioned, and against the course policies, it provides an advantage to those using it versus those that did not. This is entirely different than the alternative where its use is permitted and students can freely choose to use it as they fit. tl;dr It is straight up cheating in the former case. This is a significant offense within academia and harms not just the cheater but those that did not. Depending on the severity, punishment is warranted from a zero to expulsion or degree revocation. I'm not here to debate the merits of the AI use in college, but it is certainly cheating if its usage was not permitted. Of course it's unsanctioned.
