Originally comic characters weren't included, but that led to people being upset over things like Gotham characters being excluded (despite the fact that some, Cobblepot especially, were drastically different than their source). Overall I think this way is kind of better, but it's still flawed. In particular, the rule let in Civil War's Spider-Man, who made it to third, and Deadpool, who won. Deadpool was a tricky situation, because he did technically appear in the film universe before, but since the 2016 Deadpool film is nothing like Origins Wolverine (and is not the same character in the film universe canon) he Still got in Even after running all of these there's still no clear right answer to how to handle it imo.
