The initial VC release of Super Mario Bros is a 1:1 copy of the ROM available on any number of ROM sites. This includes metadata that wasn't part of the original cartridge, but was added by the emulation scene what dumped the ROMs in the first place. In other words, yeah they totally just downloaded a ROM and put it up on their store. Which is fair play for Nintendo as far as I'm concerned, if the idea that ROM sites exist to serve in a backup and archival capacity. Many of these sites outright say that the data should only be downloaded by someone if they have the right to use it. Who has more rights to use it than Nintendo themselves?
