Reg 09/07/18 4:53:19 PM #15:	Basically, by my understanding (and very brief research to confirm Second Degree is not a thing here), prosecution would have to prove that she actively did not think she was in her own apartment to make murder stick. Which is a high bar, obviously. Disclaimer: Despite living here for 25 years, I'm not an expert on Texas law, especially the parts I will never run the risk of unintentionally running afoul of.
