For the record, DPD appears to be handling this at least somewhat properly. They've handed it off to the Texas Rangers for an independent investigation (they explicitly said they're not handling this under the usual Officer-Involved Shooting procedures) and have stated their intent to charge her with manslaughter

It sounds like he was already inside his home and she entered by mistake, thought it was own home somehow and shot him. At least i didnt see anything saying he entered it after her. Such a sad story. She had to be on something or overly exhausted to mistake his home for her own and his life couldve been saved if he had locked the door :(

She didn't "murder" a black man, she "killed" a black man
This is why she is charged with manslaugther and not murder

I guess we don't know the specific exact circumstances of how she fired the gun, but if it's the one that seems most obvious - she walked in, saw a guy in "her" apartment and shot him for "breaking in" - then...I mean, she still shot him on purpose.

Does "I thought this was my apartment" serve as an adequate enough reason for her drawing a gun and firing it at a man and for this to be manslaughter rather than murder? A kind of imagined self-defence?

Texas doesn't have Second Degree Murder afaik

Basically, by my understanding (and very brief research to confirm Second Degree is not a thing here), prosecution would have to prove that she actively did not think she was in her own apartment to make murder stick.

Which is a high bar, obviously.

Disclaimer: Despite living here for 25 years, I'm not an expert on Texas law, especially the parts I will never run the risk of unintentionally running afoul of. This is just my first impression.

How do you go inside the place and not notice it doesn't look like your home? I have so many questions.

Where I am, that definitely counts as second degree, as an unreasonable belief that you were acting in self-defense. I guess not in Texas though.

For what it's worth, Manslaughter in Texas and second degree in Illinois have very similar penalties (2-20 for TX Manslaughter, 4-20 for IL Second Degree)

Anyway, regardless if it's a murder or manslaugther-
Why are Americans so trigger-happy in general?
I feel like this is the main issue, not gun-control in general
We here so many times about law enforcers killing people "by mistake" and it's just..hard to understand
I mean, people died in SWATTING pranks, for fuck's sake. If they shoot some nerdy gamer something is very, very wrong in how they treat guns
