Well yea... but first amendment only applies to government penalties. TC kept talking about workplace so it sounded like it was just someone getting fired and then losing when he sued his workplace.

Its not unconstitutional. Harassing somebody in the work place is not covered under Free Speech.
It's also not the government's job to tell you that you cant say certain words in the workplace. Or anywhere for that matter. That would be the company's job. Death threats, libel, etc are a different story

No but companies are able to deal with that without having to outlaw the words "saggy tits" at work. It's called harrassment. Should we outlaw every word in the workplace that hurts someone feelings?
