Illegal activities is a slight misnomer, most of it is not related to material that is actually illegal. For example, the ToU states explicitly that discussion of gambling is not permitted under Illegal Activities. Poker sure as hell isn't illegal anywhere I've been to.
When it comes to drugs, it refers to harmful substances and recreational drug use without specifying legality.
So in short, it doesn't make a difference.
