Alan Dershowitz is a constitutional lawyer. I imagine his job is to address the constitutional side of the case, which doesn't turn on actual innocence. You'd only go to him if your case raised major constitutional issues, whether or not you were innocent.

Before the Revolution, John Adams defended the British soldiers involved in the Boston massacre. The American people understood that he was not taking a side, he was doing his duty to defend everyone's right to a legal defense.
