You can argue these things are constitutional, sure. Whether they are democratic is a separate issue! The original founding documents were not very democratic at all.

That's why we've been so successful as a country. Compare with France which had a revolution a few years after us and was chopping off heads in the public squares within 4 years. What did we have that France lacked? Democracy? No. We had checks and balances.
