I think there's at least a chance the rule doesn't end up going into effect, if only because in the past when I've seen universities organize this rapidly against legislation that those laws have not been passed. I realize this is a somewhat different situation but I think there's some possibility here.

We're talking about the ICE thing, right? IIRC this isn't a matter of legislation to be passed or not - it's DHS/ICE issuing or not issuing an exception on this. I posted a twitter thread from an immigration lawyer about this in the last topic but the visa regulations as they stand already forbid online-only from being allowed and he speculated this would be what ICE would hide behind but notes that an exception could easily be granted given the exceptional circumstances of the pandemic.

Consequently, you're talking about the Trump Administration and given that this marries two of Trump's biggest things: cruelty and trying to pretend COVID is over with and everything must open... not sure about the odds here.
