Or they'll use some other game engine that's not Unity. Current existing games might run into trouble especially if they're not big money makers.
It's not retroactive, is it? I assume all those devs have contracts with Unity under the existing model.

How does this functionally work? Someone pirates the game, and then the game pings something and it pulls money out of the devs' earnings? I think I'm missing some fundamental understanding of what's technologically happening here.

No, piracy doesn't count. It's just legal downloads.
