Definitely hate crime. I'm pretty sure that clear-cut death threats make this a bit more than just 'bullying'.

How can the situation be handled properly when one of the people involved is saying that it most definitely looks like bullying? This is the most obvious example of a hate crime I've seen in a long time and yet this guy is going to let these kids get away with it with no more than a slap on the wrist. If I didn't know anybody I'd say he's most likely a huge rascist b******.
