this is why rigid laws don't work, there needs to be a molestation exception....actually if you catch someone molesting a child, you should be treated as a criminal if you DON'T kill them as brutally as possible on the spot.

no, it's fair that he does get tried on a manslaughter charge because that's exactly what he did. he didn't commit murder.

now, he's allowed to step in to defend his daughter, legally. he has full right to take physical action in the process. doesn't sound like he MEANT to kill the guy either, he just... punched him in the face, a lot, and the guy croaked. being charged with a crime is appropiate, but i highly doubt any grand jury would indite him due to the circumstances. if a loved one is being molested and you take physical action that results in the molester's death, you probably will get away with it, so long as it's not a clear case of "YEAH I KILLED HIM GO ME!" or something. that behavior shouldn't be allowed and there's several layers below outright murder.

It's definitely justified under self-defense, ESPECIALLY since it was inside his own home. If he were charged with a crime, the prosecution would have to argue that it wasn't self-defense, which is possible but really unlikely.
