The Court ruled that Arizona DOES have a right to require its police to check the immigration status of every individual they arrest (which I 100% agree with).

I have no problem with people coming to The Greatest Country on Earth to seek better lives for themselves ("legally" or not, ie by dealing with the ridiculous immigration bureaucracy put in place by Democrats), but I do have a problem with them coming here and committing crimes.

I didn't mean to suggest that in a "hey guys, settle down, I'm dropping the knowledge" way:

I was passing it on more as a thought experiment about how about how Supreme Court decisions are made and what determines their long term implications.

There were two main ways to justify it (as opposed to two ways of striking it down). It could be justified as a tax or as interstate commerce. It was not justified under interstate commerce, but that doesn't make it illegal. Tax provisions do justify it.

Pretty much Alec. They tried to play it as not a tax but really similar and failed to prove it. It's a win for Obama but a bit dirty. Of course, as a tax it still ends up functioning similarly in practice. Different politically however.

Yes

5-4 ruling that it violates the Interstate Commerce Clause
But 5-4 that it is okay as a tax



So basically, it's 5-4 that the mandate is upheld since it is now apparently a tax. I wonder if that changes how easy/difficult it will be to repeal?
