Plenty of people who never pirated a single game are getting banned. Even some people who never installed CFW at all but only used homebrew are reporting that they got banned, and piracy on the 3DS is 100% impossible without CFW.

Some people who hadn't turned on their 3DS systems for months are saying they were banned when they checked. Even a few that hadn't been used since before Christmas were reportedly hit. Apparently, Nintendo has been stockpiling this data for a while and only now decided to launch the nuke.

Yes, but it requires having a second unbanned 3DS and basically cannibalizing it to save your banned one. Plus, doing it too soon means the next wave of bans could leave you with two banned systems instead of just one. It's not worth the risk right now.

Yep, save editors for backing up and starting new games without losing anything and difficulty mods. Pokemon has this interesting hard mode thing called Nova sun https://gbatemp.net/threads/pokémon-nova-sun-umbra-moon-fully-featured-challenging-sun-moon-romhacks.462295/

And of course all those event Pokemon are fun to give away online.

Luckily for me, I've been doing the "play online on main system, personal stuff on alt system" but this is still a shock since I was just considering doing it on my main system a few months ago. Guess I dodged a bullet.

There's also the part of the friends list where it shows your "currently playing" and "favorite" games unless you have it hidden, and if one of those is a questionable game/app, that could probably trigger a ban as well. Then again, I've seen some people who did have those disabled still reporting that they got banned, so who knows at this point? There's still a lot of things we don't know at this point.

Hacking Pokemon is one of the safest things you can do. Any non homebrewer can do it with a powersave and be 100% safe. It's kind of implied Gamefreak is even working with Datel since Datel didn't release the codes last gen for event mons until they were officially revealed which they have no reason to do otherwise.

I only did it for some Pokemon I wanted since I didn't own the other versions. I still wonder, How on earth am I going to get them on the switch when a pokemon game eventually comes out on that once Nintendo stops supporting the 3DS this year?

I had both options disabled and have just confirmed that my system wasn't banned. Seems pretty likely it is just those two things.

Those people were not banned from hacking Pokemon but banned because they were huge dumbasses and edited their trainer information like their trainer ID and gender and then game syncing with it... after they've already game synced with their original trainer ID gender etc before.
Hacked Pokemon including having Marshadow in your pokedex and even items like unreleased mega stones and Z crystals remain perfectly safe. I can personally vouch for that.
