I don’t know of any incident where a private citizen has been arrested for violating another citizen’s 1A rights,

Violating one's right to free expression is one of the reason why threats are illegal

Threats are not a violation of 1A though. Again, 1A strictly issues negative commands against the gov't. SCOTUS ruled that threatening speech is not protected under 1A, meaning that you can be arrested if you make a specific, true threat. In other words, 1A can't be used as a defense if you violate US Code.

If you're going to use a phrase like "right to free expression," it helps to specify which one you're talking about. Are you talking about California's affirmative free speech policy? If so, I don't necessarily disagree with you. However, the boundaries seem to be poorly defined by the case literature that I've read.

Yes, it's free speech.

Doesn't make you any less of an asshole for saying it. Nor does it mean that people can't call you out for saying it.

Nor does it shield you from public shaming or loss of employment

Freedom of speech is not freedom from criticism,

You're right, and threatening to riot if someone is allowed to speak at a university isn't criticism. Or legal.

What about death threats and rushing the stage of a performance of Julius ceasar

I agree that it should not be criminal to say something hateful, and so I support the decision.

Then you don't understand the decision. US trademark isn't saying it should be illegal, just not able to be trademarked. You can keep offensive names, but they won't be protected by trademarks.

People here aren't really understanding the case thanks to mal fets shitposting. He will always be a shitposter and you shouldn't trust him even on issues like this. Not saying I don't agree with the results, but it's way off from what mal fet wants you to believe.

If the best thing a person can say about their opinion is that it's not illegal to express, perhaps there's a problem.

Nothing has changed.

No one gets arrested for hate speech, however the use of hate speech is an aggravating factor if a crime later develops.

The only major exception this is stuff that disrupts public safety, like intentionally causing a panic in a crowded space.

Yes it is...forcibly preventing someone from speaking does in fact make them unfree to speak.

no it isn't. They can still speak if they want. If they choose to let the force stop them its their own choice. Freedom of Speech means the Government is shutting you down...if you're speaking and i put my hand over your mouth i am impeding your ability to be heard by others i guess but your freedom of speech is still fully in tact...you are still FREE to say whatever you want right there or anywhere else...i agree with you that using violence to stop a speaker is wrong but stop making it a freedom of speech argument. it has nothing to do with the constitutional definition of freedom of speech.

Shut the fuck up people this decision isn't about free speech. Whether or not you could say it was not in question. It was whether it could be rejected as a protected trademark. Even if the decision ruled the opposite, the only difference would have been companies could now sell their own Red Skin merchandise without licensing, which in a way would be more free speech.
