people don't know about legal liability or what actually constitutes negligence.

i sure didn't before i had this job


to them we're just the big asshole insurance company who doesn't pay for anything (even though i pay more claims than i deny usually) because they think they're entitled to any damages for any reason if it was caused by someone else or arose from someone else's property and that's simply not factual.

i don't handle first party claims. i handle claims where other people are making a claim against our insured.

also if first party does disclaim coverage it's because you're making a claim for something not covered under your policy.. which means it's not something you paid for. logic how does it work?

because there was no negligence and the HOA governing documents didn't have strict liability for unitowner disputes of that nature.

legal liability isn't determined by "well the water came from here" it depends entirely how the leak occurred and what the HOA governing documents say for that condo association

especially when you live in a place that has shared walls and ceiling/floors

it's a risk of living in a place like that.

if a pipe that services my toilet under the floor breaks due to wear and tear how could i have prevented that if i didn't have an issue with my toilet? it was just as much unforseeable for me as it was for the person who got leaked on. unfortunately, a lot of times first notice of an issue is damage to another person's property.

it's a condominium complex. each unit is owned by an individual but the individuals are all governed by an HOA. HOAs usually are only responsible for common elements.
