Some states only allow handsfree mode (e.g. bluetooth). But studies show that handsfree mode is no safer than holding the phone while driving.

So why not get rid of the handsfree law (since it's the same), or just make it illegal to talk on a cell phone?

A passenger knows when to shut up (e.g. when a tricky merge is coming, when traffic starts to build up, etc.) vs. someone over the phone who has no situational awareness.
