US Attorney General Jeff Sessions has reversed a federal government policy that said transgender workers were protected from discrimination under a 1964 civil rights law, according to a memo dated Wednesday and sent to US attorneys around the country and heads of federal agencies.

Sessions memo, obtained by BuzzFeed News, says, Title VIIs prohibition on sex discrimination encompasses discrimination between men and women but does not encompass discrimination based on gender identity per se, including transgender status.

It adds that the government will take this position in pending and future matters, which could have far-reaching implications across the federal government and may result in the Justice Department fighting against transgender workers in court.

Although federal law, including Title VII, provides various protections to transgender individuals, Title VII does not prohibit discrimination based on gender identity per se, Sessions writes.

This is a conclusion of law, not policy," his memo adds. "As a law enforcement agency, the Department of Justice must interpret Title VII as written by Congress.

The memo reflects the Justice Department's aggression toward LGBT rights under President Trump and Sessions, who reversed an Obama-era policy that protects transgender students after a few weeks in office. Last month, Sessions filed a brief at the Supreme Court in favor of a Christian baker who refused a wedding cake to a gay couple. And last week, the department argued in court that Title VII doesn't protect a gay worker from discrimination, showing that Sessions will take his view on Title VII into private employment disputes.

It's the job of the justice department to uphold the letter of the law. It's the job of congress to write the letter of the law. If a law is poorly written or outdated, then naturally new classes of individuals will fall through the cracks. While this superficially is an act of bigotry, it's also the natural byproduct of the Republican insistence that law is meant to be followed, not manipulated. Congress should act immediately to update Title VII to cover this new class of citizen, but it is not in and of itself an act of bigotry to point out that a law's actual wording does not protect a group of people that did not exist at the time of the law's writing.

Do I feel good knowing that our government is following the laws as they're written rather than arbitrarily ignoring them when it's convenient? Yes. However, knowing that congress is incapable of actually passing new laws ruins that feeling, because while we should be pointing out that our laws are outdated and how that negatively impacts certain groups, we should also be passing new laws to patch those holes, and I know that's not going to happen.

As a widely recognized protected class? Of course they didn't. In the 60s we were still fighting for Gay Rights, nobody was seriously talking about "trans rights" until the early 2000s.
