I watch a lot of those Public Freakout videos and I always hear people say, "Ohh, it's against the law to record someone without their permission," while they're out in a public area. No, you don't have the expectation of privacy and people can record you as much as they like. You would think in the world of so much of this going on with YouTube and Facebook and Instagram that people would have learned this by now, but nope

I think its because there are state laws to that effect and its only recently that they've been struck down BUT that could be part of the myth

I have a go pro strapped on 24/7 and if someone questions it I turn it off and threaten them. Then I start recording and enjoy their reaction. Are you telling me I cant do this? Some States at least one person being recorded must know they're being recording, in some other Sates all parties need to be informed. I could be wrong about that, though --- ... Copied to Clipboard!

These laws differ from state to state, and have all kinds of stipulations.
In some states you need permission to post pictures of people if their faces are visible, and people can request that you obscure their likeness before you publish any footage you shoot of them. That may change from place to place depending on what they're doing when they're caught on camera. Marching the streets is one thing, but talking shots of people just in public is another, especially if someone stands to make money off of it. Then there's the question of court admissibility.
