Okay, I'm slightly confused as to what second degree murder actually IS.

Like, first degree is premeditated. Third degree is like crime of passion sort of stuff (I think.) But I'm not sure what second degree is.

A quick wiki search says 2nd degree is still intentional but not premeditated, but the difference is like third degree is if you found out your wife was cheating on you with your neighbor so you killed your neighbor during a dinner you had with them, while 2nd degree would be you killed your neighbor during the same dinner just because you got into a fight. It's the "crime of passion" thing that makes it 3rd degree.


That...doesn't make it any clearer to me.


Its the intent to kill thats the difference

2nd is an intentional murder that happened in the moment

3rd is things went too far and I killed him without thought


Okay, that makes sense. First degree is "I had a fight with my neighbor. I'm making a plan to kill my neighbor based on this fight.", second degree is "I'm having a fight with my neighbor and I pull out a gun and shoot him", and third degree is "I'm having a fight with my neighbor and I get so angry I hit him hard enough to kill him."

Kinda...the difference between second and third seems fuzzy.

Regardless, if both first and second degree murder were what the prosecution was pushing HARD on, then I can totally understand the jury's decision. The SECOND it was revealed that the bullet was a ricochet, the charge SHOULD have been negligent homicide or manslaughter. By pushing for a clearly trumped up charge, it paints the prosecution in a bad light, like they're trying to railroad the defendant, which colors the jury's perception of the more accurate charges. I'm not saying the jury was right, but goddamn the prosecution seems like they fucked up.

Like, when there's evidence that the bullet ricocheted off the ground, the guy couldn't have possibly actually aimed at Steinle unless he's one of the greatest trick shots in the world, so to barely even mention the victim in closing arguments and then paint as silly of a picture as "He spun around on a stool for 20 minutes and then shot directly at her, intending to kill her?"

Yeah, the jury should have still convicted on involuntary, but holy crap talk about poisoning the water, there.

I dunno why everyone is ignoring my posts about it, but yeah, this lines up perfectly with what I said.

The prosecutor hammered on the point that it was fully intentional, and when the jury decided they didnt buy that, the remaining evidence didnt make the case beyond a reasonable doubt for the lesser charge.

I know you mean "well if he wasn't here as an illegal immigrant, she wouldn't have been shot by him", but the fact is that you could also say "if we had stricter gun laws nationwide, then a non-citizen who has no second amendment rights wouldn't have been able to easily obtain a firearm and shoot her".

I'm not disagreeing, but negligent homicide seems to often go overlooked. I mean how often do you hear of a toddler getting a hold of a gun, and shooting themselves? It's negligent to leave a gun laying around with toddlers in the house (especially loaded).but often parents won't be charged. Or when someone mistakes a person for a deer (because I know when I see my neighbors down the street, I think "What's that deer doing over there?") Or when someone shoots their own kid while cleaning their gun. Or heck when a drunk driver plows into 4 people and kills them (The Ethan Couch case still boils my blood)

I'm not sure exactly why, but it might have to do with how the prosecution presented the case. Or any other number of factors. State laws, etc...

It's hard to say without all the facts of the case to be honest, and without knowing what the prosecution presented. I think a lot of people want to look at this case as "He's an illegal immigrant!" But that's not really the right way to go about it. Him being legal or illegal isn't really pertinent. Either way, he should be charged with negligent homicide. I mean if he was just a homeless man who had committed the same other crimes in the past, it wouldn't really make his actions any better.

As much as conservatives love to say liberals are elitist assholes who look down on all conservatives, when Ulti and ExTha make posts like the ones they're making (about this being a crushing blow for liberals) in response to an event like this...it always comes across as condescending towards their own voters. "Nuance won't matter, they'll just see that a Mexican got away with murdering a white woman and that issue will piss them off enough to vote Republican in droves, as though they have no other issues that they consider important."

And the sad thing is that I don't even disagree. It's just that I think it's a BAD thing to have one political party so easily manipulated, while conservatives seem PROUD of this trait, and how it gives them an advantage over Democrats.

That's a fun story.... it's also not remeotely what happened.... he didn't leave because of his beliefs. He turned down a contract because he thought he deserved more money (admittedly his right, there wasn't anything inherently wrong here), but being that he can't read a defense he also apparently can't read how little interest there was going to be for more money...

And yes, he says he'll come back now and stand for the anthem (which should kill any chance he had at this award...) and play for a whole lot less money. But the problem is in
Leaving the way he did he made himself THE story of the league, and no team or coach wants to deal with the distraction that being on the team will cause, not for someone mediocre at best. Yes, he is awful, but there are (probbaly) worse QBs in the league. I won't deny that. The difference is they won't cause a hassle for their team. He would.
