Usually you pay first and last months rent along with a deposit (refundable) and if you have a pet sometimes a pet deposit (non-refundable).

Any agreement they would come to would be on top of the normal return of the deposit, and of course if she already paid last months rent, that would be factored in as well.

The important thing here is to know that it's a prime time to sell, and many think the market is going to go the other way in the next few years. New evaluations happen in the next month or two, so this is a very time sensitive issue.

I'm thinking of selling my house, but am holding off as I figure at worst it'll go down a bit in value, and probably stay around the same (might even go up a bit more). My home went from 315k in value in 2015 to 422k in 2017.

From a pure finacial perspective it probably makes sense to sell my home right away if I could, as the likelyhood it'll go up a bunch more in value is low...but I am actually living here and it would be alot of work and a big change.

In Jen's new owners case though selling fast is a way better idea, as it's a crap shoot without good odds right now that the value will actually increase. So yeah, I'm sure he's highly motivated to make a deal.

you have to understand houses in my area can sell for $250,000-300,000 and they're just small 70s single floor houses. simply because of location.

if this guy pays me $7k to move out of a house he probably got for $120k as part of a bulk sale from my current landlord (7 houses) he's still making out like a fucking bandit for his flipping house sales.

i am going to at the very least not move unless i receive:

my deposit back for this home ($1100)
first month rent in my new place (to be determined but i'm not gonna get greedy obviously, it will be similar to our rent now $1200 which we can afford)
deposit for my new house (around $1200)
a pet deposit for my new house (whatever the charge is)
rental application for a new house
any and ALL moving expenses, which will include movers because of the inconvenience of moving (>=] college hunks move your stuff here we come)
and last month rent if required.

BUT i'm going to start HIGH and see if he wants to negotiate down to those things so i make out with what i want and he gets what he wants.

Shit, that can be dangerous if he consults an attorney etc.

Again, he just needs to say he is actually moving into the house and your screwed (There is no legal limit dictating how long he needs to live there before selling).

That is of course if what he is saying is true, and from what the girl at the office said, about hopefully him not doing that for all the properties, it may not be true.

Even if it is true, he would at least need to legally move into the house and change his address, for a month or two, so it would still be worth at least 2 months rent just to avoid having to do that.

Does give him an out if your the only ones with a lease though. Still think contacting the other tenants would be a good idea if you could swing it. More information is never a bad thing.

not for me. i have a lease agreement either with him or my current landlord. that'd be a dispute for him and my current landlord lol. either way i have a contract signed that has been legally transferred with the house and if he wants to dispute the sale he'll have to take it up with the property manager and they'll honor my lease and try to sell the house again. my PM has like 100 houses they are trying to liquidate so they can retire.

well it's the area we live in. i have a 2br/1ba house from 1970 with a big yard for $1200 a month. it's not a great house. but the area is fantastic.

if we move to a different area we could pay the same rent or less for a 3-4br/2-3ba house with a yard etc.

Hope I'm not giving too much advice, let me know if I am.

I would suggest stating just a flat figure that you consider fair for you to move, and let him know you can break down the specifics if needed. He could easily just go for a number, but if you break down individual points, he might decide to argue some of them.

I would also review your contract/lease as quite often there is a clause for breaking the lease included. This is usually done for the Landlords protection, but would give you a clear starting point (you could ask for more, but would in no way agree to less then that amount).

Also, it matters if he actually served you with a 30 day notice already. In most states at least, all the protections are there for the tenants, giving them quite a few ways to break a lease without penalty (unfixed/repaired items, finding another person to rent the unit in your place etc).

There is no....specific...penalty (well at least in the states I have lived in) for a landlord that serves a 30 day notice that can't be enforced (for whatever reason), but..there is if the landlord actually tried to physically remove you (with the help of police, changing your locks etc). That didn't happen in this case, but it's still good to keep in mind he served you with a 30 day notice. It's his error, and if you do end up in court it could matter.

Remember, even if you don't end up getting squat from him now, you might actually still get something from court later, if you end up having to move (due to pressure etc) before your lease expires. Since he already served you with a 30 day notice, that would give you enough reason to show you felt .....pressured to move....and require financial compensation.

Best to just negotiate, but yeah, you have options if that falls through, so stand strong.

i have reviewed my lease 100 times because of the nature of my job. that's why that handwritten note was such a huge red flag to me. i knew my lease didn't give him grounds for a 30 day notice at all.

he didn't. he thought they did but the secretary at his company confirmed they never mailed me a notice to vacate in 30 days. legally per my lease they need to give me at least 60 days so i would have fought that.

if he did any of that he would have grounds for a lawsuit against him, which i am prepared for. in my state i can get 3x damages for unlawful eviction and my attorney costs paid. plus since i work for an insurance company i could have found an attorney likely to take me on initially with no out of pocket cost to me at least for a consultation and then i could hire them on contingency. and it's not a conflict of interest because it's not related to my job. they would just do me a favor of not charging up front because they have relationships with a lot of us.

the beauty is they DIDN'T send me the 30 day notice. he just thought they did. he works for an LLC with a partner and at least a secretary so there must have been something lost in translation somewhere.

In theory, it prevents flipping of houses (which it does), but in practice it just leads to a bunch of zombie houses that the owners don't want anything to do with because they are stuck with them and don't want to pay for maintenance. My neighborhood has about 4 - 5 of them that have been abandoned for a while, one is literally two doors down from me. Which is a shame because when I moved in that house was amazing. If it was up for sale a year earlier when I bought my house I probably would be living there now given how nice it is.

No complaints there. I mean the intent was good since it is a neighborhood of starter homes (3 - 4 bedrooms on half acre lots) and the flipping was out of control there. But I just don't think it was implemented properly.

So people are still buying house to flip them? And are waiting 5 years or so to sell them? I feel that would cost more since you would either have to keep them looking good. Or fix them after they become a zombie house.


I think the problem is that we are literally the only town in the metropolitan area with this rule, so people who buy tons of houses don't realize it and get stuck with the house.
