play games for the console you made yourself? If you are using a playstation emulator or something you could also pop your own discs in and play them with the disc, idk about the legalities around that tho

It's like back in the day when you bought a cassette, VHS or CD and copied it to other cassettes, VHSs and CDs and gave or sold it to your friends.

Same with games.

But really it's the up-loaders that get Federal heat.

Buying the emulators is legal but thats about it. The exception is stuff like the NES classic. Its an emulator with pre packaged roms and its all licensed and ablove board.

As long as it doesn't use code from the original system it's considered an original work. Sony, MS and Nintendo couldn't just take someone's emulator either since they don't own that code. Some emulators require a BIOS dump and typically don't include one by default because that code is copyrighted by the company that made the system.

The laws regarding making and keeping your own backups are kind of a mess. There's a lot of stuff that's on the books but untested in the courts and the game companies don't seem to want to risk losing and setting a precedent that doesn't benefit them. Making a personal backup for archival purposes is ok in most places though.
