I made a topic a couple of weeks ago about how one of my best friends was in jail accused of sexually abusing an infant. At first I couldn't believe it, but I tried to stay in the middle, because I had zero information other than what little a friends mom told me, and news reports.

Now, about three weeks in I am in almost certain he committed no crime. I do not say this lightly, and I am treating the accusation as serious because if it happened it is messed up beyond words. Knowing what I know now, I do not think he has committed any crime.

Three weeks after he was arrested the police have no real evidence, just the initial claim. The police have asked other victims or people who knew my friend to step forward with anything they knew. the police believed he had "other victims" and so far nobody has said anything.

The mental and physical examination of the child turned up nothing at all.

The police searched my friends computer for anything suspect and found nothing.

At his preliminary hearing the parents of the victim were not present. I dont know much about how this court stuff works to see if that is odd or not, but it seems odd. My friend had people in his camp outside of just his lawyer. I was not there.

The claim referenced how he supposedly did the act, and somebody I know has seen a photo of the bathroom it allegedly took place and said it isnt wide enough for that to be physically possible.

Things could come out in the future to challenge this view, but to me it seems like a bogus claim. Police are treating it seriously, as they should, but havent found anything.

I just had to get this out there. I could be wrong, but everybody on my friends side agrees this sounds ridiculous, based on the facts above.

I don't even know what I can and cant say about this, I havent spoken to his lawyer yet, but im aching inside and i feel like im going to explode. I'm sure this will lead to a lot of questions from you guys. I likely wont answer much of anything.

What I mean is, the criminal report references a sex act done over the toilet. A person I know saw photos of the bathroom the act supposedly took place and described it as being too narrow of a room for the act to have occurred in the way it was described. not enough space.

I dunno how small a bathroom it'd have to be to not be able to fit one adult and an infant.

This. It seems they probably claimed it was a specific way. And maybe that act couldn't be done in that bathroom. That could be especially true for a smaller bathroom. Like a half bathroom...

A half bathroom is pretty small. You could fit an adult and infant in. But it might be hard to do much is a small space like that...

Happy to hear that -- since, if nothing else, it means no child was harmed. However, it just makes the story stranger since it implies that the parents acted maliciously despite, as you previously mentioned, having no real motive.

Personally I had assumed that it was just parents overreacting to something the kid might have said or done, but your story makes it sound like they're up to some weirdness.

I mean if there's no evidence he's getting away with it regardless of whether he did it or not, that doesn't tell me much. If the psychological evaluation returned nothing, that's more convincing.

Then who reported it? What were their motives?

I believe the child told his parents. My friend worked for the family and they allowed him to be near their child.

this is going to sound ridiculously stupid but I thought infant meant something else. Uhm, yeah anyways i can't edit my OP now but the child in question was 6 years old.

i, uhhh....thought infant was much older for some reason.

Infant is a baby, a small baby at that. Hell, 6 is beyond toddler range even. Kindergartner is 6.

i...feel like a moron for making that mistake. im being cautious as to what I say here and I guess i overthunk and chose my words incorrectly.

just to repeat myself: op is a lie, victim in question was six years old. So like, during the psychological examination the victim was able to talk back and answer questions and stuff, if that gets you a different picture. an infant wouldnt likely provide much psychologically i dont think.

His lawyer got him transferred to some sort of behavioral health hospital or something

i have reason to believe while in prison he was beaten, though I am not sure. During his prelim he had a chain wrapped around his stomach near the belly button, i am told. it was not connected to anything else. his cuffs were both hands together in front and legs. There were two inmates also having prelims at the same time, and neither had the stomach chain. If I had to guess this is to make it so his shirt cannot be removed or lifted upward. I could be wrong though. I wasnt there, that is just what i heard.

The belly chains are attached to the hand cuffs. That's how all inmates are brought to court. I have never seen an inmate without the belly chains. Also, he probably got transferred to protective custody, which means his charges were discovered and he was no longer safe in gen pop. The only issue with that is that will follow him if he goes upstate (prison) once you're a pc everyone finds out super fast.
