This issue isn't really affecting pirates in the traditional sense since pirated games are already banned. It's for those that dump their own games and then eventually sell it. If two of the same identifier is ever detected, it's blocked from ever going online again. It's not an easy fix because Nintendo would have to replace the cart if someone buys it used and they get stuck and call Nintendo. You literally cant tell the difference without thouroughly checking it. That ban then carries on even if you wipe the system and sell it to someone and they have a clean account (they get banned), and also carries on if you use your banned account on another system (Switch gets banned as well).
