Im undecided on this issue honestly. From what I know most countries dont have a system like this and being born in a country doesnt make you a citizen of that nation unless you were born to parents who are citizens.

Im not sure what the benefits are of the way we have it currently.

I was ironically reading about this just the other day, based on a completely unrelated discussion about dual citizenship.

At the time my reaction was basically along the lines of, "Hmm, why DO we still do things this way? It seems like there are a lot of better ways to handle citizenship that wouldn't constantly encourage birth tourism."

The interesting part is that most nations in the Americas have policy along these lines, while very few nations in Africa or Eurasia do. Which implies it's probably a mindset strongly influenced by colonialism.

Yes. Constitutional changes require more than a single signature.

A lot more.

It is an amendment, right? So the only way to nullify it is with a new amendment? If so, yeah, that will take a lot more effort than simply signing a paper.

I think it is an interesting concept. But I think in practice it would have the opposite effect of what right wingers want. Most Americans can't pass a citizenship test while most immigrants do. It would also mean children would need to work to become citizens and if the child is handicapped that could cause issues. Or if a student is home schooled or goes to a poor school they may not be learning all the right stuff. So many poor and disabled people would be left without a country. And schools in general would be a toss up on if the kids can even go.

Or, more likely, you become an automatic citizen if both (or at least one) of the parents is a citizen.

Doubtful they'd attempt to test every single person in the country. That seems like a logistical nightmare.

You have to be a natural born citizen (born in the US) to be president. If being a citizen is no longer a product of being born in the US, then they'll say that anyone who successfully jumps through what will undoubtedly a racist and classist system to become a citizen, can be president.

I don't agree with birthright citizenship under all circumstances. Just hopping the border and pushing out a kid is a scam and unfair to people who follow the rules. Unless you enter the country legally (even just on a tourist visa, etc.), it shouldn't count. Refugee babies would still count because that is a legal entry...

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

One could argue illegals aren't subject to our jurisdiction, so the amendment wouldn't apply to them.

I dunno, I wouldn't just assume Trump's executive order violates the Constitution as it's never gone to court before.

The problem is that the way its written (purposefully) allows birthright tourism. The 14th amendment would have to be rewritten.


Rewriting it is the best option in this case.
