In 1983, Utah was the first state to lower its blood alcohol limit from 0.10 to 0.08 for impaired driving. It would take nearly two decades for every state to follow suit, but as they did, the nation's rate of alcohol-related traffic deaths dropped 10 percent. Now, Utah is pioneering the move to lower it once again.

Beginning Dec. 30 yes, the day before New Year's Eve Utahns will have to be extra careful about drinking and driving. On Sunday, the state's blood alcohol content limit will drop from 0.08 percent to 0.05 percent, marking the strictest DUI law in the country.

To give you an idea of the difference in consumption, for a man weighing 180 pounds, it takes about four drinks to reach a BAC of 0.08 percent, according to the American Beverage Institute. But to reach .05, it's about half as many drinks and can be even fewer for women.

The current limit of .08 is "a significant amount of drinking" for a lot of people, says Utah state Rep. Norm Thurston, a Republican.

Thurston sponsored the bill to lower the limit in 2017 at the request of the National Transportation Safety Board, which has been urging states to lower DUI limits to 0.05 since 2013.

Thurston says he believes the new limit will save lives because it sends a strict message to anyone who has been drinking not to get behind the wheel.

"You would think that we're already there as a society," but Thurston says he meets a lot of people who say they think it's safe to drink and drive, "just a little bit."

Critics slammed the Republican, a practicing member of the Church of Jesus Christ of Latter-day Saints, for running the bill. The church urges its members not to consume alcohol, and many accused him, as a Mormon, of trying to legislate drinkers and non-Mormons.

The American Beverage Institute, an alcohol trade organization, has been a vocal critic of the law. Spokesman Jackson Shedelbower says he doesn't believe the change will save lives. The lower limit targets social, moderate drinkers, not "legitimately drunk drivers," he says.

"Nearly 70 percent of alcohol-related fatalities in this country are caused by someone with ... a BAC of 0.15 and above," Shedlbower says, three times the new limit in Utah.

So, will drunk driving arrests in Utah increase starting Dec. 30? Probably not, says Sgt. Nick Street with the Utah Highway Patrol.

"Troopers and officers throughout the state should already be arresting based on impairment, not based on a per se limit, and that standard is not going to change," he says.

Street says he believes the law has already changed drivers' behaviors, even though it hasn't taken effect yet.

"I think people are making better decisions on the front end of a night," by using ride-hailing apps or choosing designated drivers.

probably because I live in the state but this news is like 10 months old at least

go to jail and get $10,000 in fines + probation and alcohol classes just because you have 1 glass of wine for xmas that doesnt even impair you noticeably

If it doesn't impair you noticeably you wouldn't get pulled over in the first place. At the very least they won't test your BAC if it wasn't for erratic driving.

If they aren't, then they might not be too drunk to drive anyway. The purpose of the limit isn't so much to pin down a specific number that is universally the threshold between sober and drunk (since that's not really possible), it's mainly so that if you're driving like an idiot and the police pull you over, they have something to point to to prove you were too fucked up to be driving.

Im so glad to be out of Utah. This was starting to be pushed right as I left about 1.5 yrs ago. I knew more people with DUIs than not out there, the cops were already overzealous with the breathalyzers, I was asked to blow into one in the middle of the day when I was pulled over for using a carpool/HOV freeway entrance (just me in the car) but I dont see why that would be an indication I had been drinking. Terrible law.

This is just silly and impractical. Most people experience almost no impairment to coordination at less than .03 - .04% BAC. Other factors, like driving home after a long day at work, are more impactful than alcohol at those levels.

This is just silly and impractical. Most people experience almost no impairment to coordination at less than .03 - .04% BAC. Other factors, like driving home after a long day at work, are more impactful than alcohol at those levels.


Plus there are medications that can cause impairments far greater than the BAC limits

Dont break the laws

It may sound silly, but it was accidental. Even if it werent, I shouldnt end up with a whole DUI on my record (which in UT gets your drivers license taken away for a year min) just because I made a mistake and happened to have a glass of wine with lunch, which would be unrelated to why I made the mistake.

People who support this are people who legitimately and honestly believe that if you take a sip of wine for communion in church in the morning and then take a drive after dinner and get hit by a plane falling out of the sky, it was your fault and the direct result of that sip of wine and no other factors were in play.

LMFAO, when has reason and common sense ever stopped a pig from ruining someone's life?
They get pulled over for something else (headlight out) and then get tested. Or random road stops. As long as they can document that the driver was technically over the limit, it does not matter if theyre actually intoxicated or not. Gotta feed the coffers.

P much. I had a coworker who took a temporary assignment in Utah once. He said that his neighbor at the apartment he was staying at was really friendly and they would talk every day. Then one day he (coworker) was coming home from getting groceries and had a six pack in his hand. The neighbor saw him, stared at six pack like a murder weapon, and didn't speak to said coworker for the remainder of the time he was out there.

In NY you can get popped for 0.05-0.07. it's called driving while ability impaired (dwai), and while it's not a misdemeanor you get your license suspended for 90 days.

But there are people who do get impaired at < .05% BAC, and law's are designed for the Lowest Common Denominator, as a Safety net.

And yes being tired is more impactful than alcohol, that's why you shouldn't drive if you're that tired. You're a risk to everybody and yourself.

Are you swallowing the Mouth Wash so that the Alcohol gets into your Blood Stream?

If the Cough Medicine impairs your judgement, you would get prosecuted with a DUI here in California if a Police Officer caught you.
