And it will be a primary offense...

But apparently the loophole in the law is that the officers have to inform you of your rights and you have a right to not turn over your cell phone. So how can they prove you were texting?

I could've sworn this was illegal for a long time already.

It was a secondary offense which means they couldn't pull you over for it but you could get a ticket for it.

Over here, the police officer writing in his notepad that he saw you is all the evidence that is needed for a conviction

Well apparently you can look at your phone if it's a weather alert or GPS or inputting an address on GPS.

So it was already illegal, it's just now the penalty is upgraded

there should be a tougher penalty for texter drivers. they could kill someone.
