25 y/o Maxim Smith learned his unfortunate fate in court as the White Bicyclist in Washington DC was sentenced to 3 YEARS in prison for the brutal assault against a black driver with a bike lock and hurling a racial slur at him!!

He was convicted in June of assault with a dangerous weapon and assault with significant injury

The 3 year prison sentence follows 3 years of supervised release

35 y/o victim Ketchazo Paho addressed the verdict with "Violence and hate is not the answer. Think things through.."

On August 6, 2018, Smith was slowly biking ahead of Paho, a quality assurance specialist from Maryland, and evidence shows Paho honked his horn and Smith yelled expletives at him and did not move from the middle of the right turn lane

He then tried to pass Smith on the left side and Smith responded by smacking the back of the man's car

Paho pulled over to inspect the damage and called 911 and that's when Smith turned back and saw him on the phone and shouted to him "Are you really calling the police?" and then repeatedly called him the N-word

Smith then rode aggressively towards him and the 2 got into a fight and the cyclist grabbed his metal u-lock and sstruck Paho over the head with it while yelling racial slurs

Paho was left covered in blood and had 21 stitches on his head and posted it with the hashtag #attemptedmurder and #hatecrime

Prosecutors labeled this a hate crime but the jury DID NOT reach a UNANIMOUS verdict on that as an attorney for the 25 y/o, who is a native of Ukraine, says he was DRUNK and on COCAINE

Smith was adopted by an American couple a a teen and apologized for his actions but insisted he is not racist

He said "I wasn't myself at the time. I should not have been on the road"

He said he assaulted Paho over FEAR of his safety despite being the aggressor

He also said he used the N-Word after listening it from RAP MUSIC and growing up around "african-american friends".

Smith claims he used the word just to "emotionally hurt" Paho and to get a rise out of him even though he claims he himself is not racist

His adoptive mother and "african american best friend" testified on his behalf and says they have been best friends for 10 years and says he's never shown animosity towards members of other races. He also showed everyone Smith's social group that all of his friends are black and has NO WHITE FRIENDS and says he can't possibly be racist if the evidence says otherwise.

The 25 y/o is on trial again in October on an unrelated case after having ANOTHER alteracation with a black lyft driver and damaged his car and used the n-word

Can you still be racist even though you have friends of people of that race?

It never ceases to anger and disgust me that in the U.S., "But I was drunk!" is a mitigating factor in sentencing for criminal behavior rather than a cause for exacerbating the penalty.

For many crimes, sure, but for something like a hate crime it suggests that the actual motive for the attack was likely something other than hate. And, in general, I'd more support legislation that carries an added penalty for being intoxicated or on drugs at the time of arrest than a hate crime legislation.

I don't necessarily think if someone uses a slur during an altercation that it makes them racist/sexist/whatever, sometimes people just say the thing that hurts the most, which is usually a slur

Hot take time: Who gets into a fight with someone without having some level of hatred/animosity toward that person for one reason or another. Also, I'd wager that a black guy hurling a racial slur at a white guy in a fight wouldnt even be considered for a hate crime. There are plenty of examples to back up that hate crimes typically only go one way. I remember after the Trayvon case white kids were being randomly attacked by groups of black teens and weren't being charged for hate crimes. Bias in a court of law shouldnt exist.
