A quorum under North Carolina law is defined as the majority of legislators. They had 64 out of 120 present, so they had their quorum. Not that I agree with it, but that's why they were able to do it.

Also am I the only one who finds it completely suspect that it's three-fifths rather than two-thirds? Wasn't there some other notable compromise that used to be in effect that used "three-fifths"?

Depending on how it works they might not have had a quorum required to conduct business though.
